|a في إطار اهتمام المنظم السعودي بالتطور الاقتصادي الذي تشهده المملكة العربية السعودية، فقد صاحب هذا التطور الاقتصادي تطور في النظم التي تساعد على إتاحة المناخ المناسب للاستثمار داخل المملكة العربية السعودية. وعلى رأس تلك الأنظمة، نظام الاستثمار الأجنبي السعودي، الذي أظهر المزايا التي يتمتع بها المستثمر الأجنبي. الأمر الذي يدفعنا إلى القاء الضوء على الضمانات التي يمنحها النظام السعودي للمستثمر الأجنبي. تمثلت تلك الضمانات في نوعين من الضمانات، ضمانات مالية وضمانات نظامية. وعلى الصعيد الآخر بينا في البحث كيفية مسائلة المستثمر الأجنبي في حالة الإخلال بالتزاماته تجاه المملكة بوصفها دولة صاحبة سلطة، وإخلاله بالتزاماته تجاه الأشخاص الخاصة. فتحدثنا عن المسؤولية المدنية للمستثمر الأجنبي من خلال الأنظمة الوضعية وذلك من خلال بيان طبيعة المسؤولية المدنية للمستثمر أجنبي وأركان تلك المسؤولية.
|b investment within the Kingdom of Saudi Arabia. On top of these systems is the Saudi foreign investment system, which demonstrated the advantages enjoyed by the foreign investor. Which prompts us to shed light on the guarantees that the Saudi system prohibits to foreign investors. These guarantees consisted of two types of guarantees: financial guarantees and regulatory guarantees. On the other hand, we showed in the research how to hold the foreign investor accountable in the event of breach of his obligations towards the Kingdom as a state with authority, and breach of his obligations towards private persons. We talked about the civil liability of the foreign investor through the statutory regulations by clarifying the nature of the civil liability of the foreign investor and the elements of that responsibility.
