|a لقد شرع الله سبحانه وتعالى الشرائع لصلاح أحوال الناس في الدنيا والآخرة، وأباح لهم جميع ما في الأرض من أطعمة ومعاملات، فالأصل في المعاملات عموما الحل، فلذلك قمت ببحث موضوع التنمية المستدامة والذي ظهر على الساحة حديثاً، وعنوان البحث: عقد السلم والاستصناع ودورهما في التنمية المستدامة، واستهدفت في هذا البحث والدراسة بيان مشروعية السلم والاستصناع وأركانهما وشروط وأهمية كل منهما، كما أنني بينت حقيقة التنمية المستدامة: مفهومها، خصائصها، أهميتها، أهدافها، والتأصيل الفقهي لها، ثم بينت دور عقد السلم والاستصناع في تحقيق التنمية المستدامة. ثم إنني اتبعت المنهج الوصفي التحليل، وكذلك المنهج الاستقرائي من خلال تتبع أقوال الفقهاء وما استدلوا به من أدلة. وقد توصلت إلى عدة نتائج من أهمها: أن الفقهاء مجمعون على مشروعية عقد السلم، كما أنهم في الجملة متفقون على جواز عقد الاستصناع، وأنهما عقدان بديلان عن كثير من العقود الربوية، ثم إن عقد السلم والاستصناع لهما دور كبير في تحقيق أهداف التنمية المستدامة سواء الخاصة منها أو العامة.
|b God Almighty has legislated the laws to improve people’s conditions in this world and the hereafter, and He has permitted them to have all foods and transactions on earth. The principle in transactions in general is permissibility. Therefore, I researched the topic of sustainable development, which has recently appeared on the scene, and the title of the research: The Salam and Istisna (ordering to make) and their Role in Development. In this research and study, I aimed to explain the legitimacy of Salam and Istisna’, their pillars, conditions and importance of each of them. I also explained the reality of sustainable development: its concept, characteristics, importance, goals, and jurisprudential rooting for it. Then I showed the role of the Salam and Istisna’ contract in achieving sustainable development. Then I followed the descriptive analytical approach, as well as the inductive approach, by tracking the sayings of the jurists and the evidence they inferred. I have reached several results, the most important of which are: that the jurists are unanimously agreed on the legality of the Salam contract, and in general they agree on the permissibility of the Istisna’ contract, and that they are two alternative contracts to many usurious contracts. Then, the Salam and Istisna’ contract have a major role in achieving the goals of sustainable development, both private and private. Including or public.
