|b Maritime pollution is a special offense resulting from violent acts against the sea (aquatic or marine) environment that has so far been detrimental to fauna and flora. In fact, in order to cut down the cost of cleaning up and emptying the ship, a captain is likely to commit a breach of the law of oil discharges. It is an economic offense with a technical aspect, the criminal acts of which are hard to prove. What's more, the international character of the offense urges the states involved to harmonize the international conventions with the provisions of domestic law with a criminal purview so that effective repression of maritime pollution can be effectively implemented.
|d La pollution maritime est une infractions spéciale matérialisée par actes de violence contre l'environnement marin qui préjudicient jusqu'à présent à la faune et la flore marines. En fait, pour réduire les coûts de nettoyage et vidange du navire dans le port, un capitaine peut commettre des rejets illicites d'hydrocarbures. C'est une infraction économique qui revêt un aspect technique dont les actes délictueux sont très difficiles à prouver. D'autant plus, le caractère international de l'infraction exhorte les États impliqués, à homogénéiser les conventions internationales avec les dispositions du droit interne à portée pénale, aux fins de mettre en œuvre une répression effective à la pollution maritime.
