|b Maritime crime is a phenomenon which has recently become more rampant. These are illegal acts of violence that do not have the same features of the common law offense. Maritime terrorism is a specific crime where the sea and ship are two necessary elements in the qualification of the terrorist act. The movement of the ship not only in internal and territorial waters but also on the high seas and in foreign ports makes legal repression a bit challenging. It particularly gives rise to another problem that lies in the discrepancy between laws at the international level and legal repression which can be more or less effective only when applied in accordance with the rules of domestic law.
|d La criminalité maritime est un phénomène qui a récemment monté en puissance. Ce sont des actes de violence illicite n'ayant pas les mêmes traits de l'infraction de droit commun. Le terrorisme maritime est une infraction spécifique ou la mer et le navire sont deux composantes nécessaires dans la qualification de l'acte terroriste. Le déplacement du navire non seulement dans les eaux internes et territoriales mais aussi en haute mer, ainsi que dans les ports étrangers, rend la répression n'est pas sans difficulté, d'autant plus qu'elle pose en outre un problème de concurrence des lois pénales au niveau international, qu'elle ne peut être, plus ou moins, effective que selon les règles de droit interne.
