المستخلص: إن من معالم الاجتهاد العمري نظره الملازم للمقاصد وسعيه لتحقيقها وحفظها بشتى الطرق والوسائل الصالحة. فالتنبه لمقاصد الشريعة الإسلامية ومعرفتها وضبطها شروط للاجتهاد والموازنة بين المصالح فيما بينها وبين المفاسد، ملكة لمن أحاط، من ضمن ما أحاط به، بالمقاصد. وفي اجتهادات سيدنا عمر رضي الله عنه نظر للمال وانتباه للمقاصد وتغليب للمصالح وجلب وإقامة لما يكترها. ودرء ودحض للمفاسد. يحاول هذا المقال دراسة جملة من اجتهادات سيدنا عمر دراسة أصولية، فينظر في رعي سيدنا عمر المقاصد الشريعة. ويلاحظ أن المسألة الواحدة قد لا تدخل في باب وحيد بالضرورة من أبواب المقاصد الخمسة ولكن في أبواب متعددة. وهذا من شمولية الدين وترابط مقاصده وتكاملها وانتظامها كلها في خيط واحد.

One of the hallmarks of Umar's ijtihad is his constant consideration of the maqasid (objectives) and his efforts to achieve and preserve them through various suitable means and methods. Awareness of the objectives of Islamic law, along with knowledge and understanding of these objectives, are prerequisites for ijtihad. Balancing interests and harms is a skill possessed by those who are well-versed in the maqasid. In the ijtihad of our master Umar, may Allah be pleased with him, there is consideration of the outcomes, attention to the objectives, prioritization of interests, promotion and establishment of what increases them, and prevention and elimination of harms. This article attempts to study a number of Umar's ijtihads from an Usuli (principles of Islamic jurisprudence) perspective, examining how Umar considered the objectives of Sharia. It is noted that a single issue may not necessarily fall under one category of the five maqasid, but rather multiple categories. This reflects the comprehensiveness of the religion and the interconnectedness, complementarity, and consistency of its objectives.
