|a أن العمل بنظام المحاكم الإلكترونية والاستفادة من تكنولوجيا المعلومات، وتهيئة وسائل ونظم حديثة تمكن الأشخاص من تسجيل دعواهم ودفع رسومها وحضور أطرافها أو وكلائهم وتقديم أدلة الإثبات والترافع وتقديم الطعون والقيام بكافة الإجراءات من خلال وسائل إلكترونية تختلف عن الوسائل التقليدية كونها تتميز بسرعة إنجاز الدعاوى وتبسيط إجراءات التقاضي من أي مكان دون الحضور الشخصي، وللمحكمة كل ذلك مصحوب بالمحافظة على امن المستندات المقدمة إلكترونيا وحفظها من التلاعب مع إمكانية الاطلاع عليها للأشخاص المصرح لهم. ويثور التساؤل الحقيقي عما إذا كان استخدام وسائل التقاضي الإلكتروني يساعد على تقليل الفساد والحد منه من خلال توثيق طلبات المتقاضين ودفوعهم ومذكراتهم بما لا يسمح بالتلاعب في الصياغة لأي شخص فلا يستطيع أحد أن يحذف أو يضيف أو يختصر العبارات الواردة بأي وثيقة، وكذلك يؤدي تعامل المتقاضين أو من يمثلهم عن بعد (بالدخول إلى الموقع الرقمي للمحكمة) إلى تقليل كثافة المترددين على المحاكم لرفعها وقيدها ومتابعتها من ناحية، وإلى توفير الجهد على ذوي الشأن وذلك بمعرفة الإجراءات المتتابعة رقميا، ومما يؤكد تقليل الفساد هو توفير الوقت اللازم لتلقي مكاتب إدارة الدعوى لصحف الدعاوى والطعون وقيدها في السجلات المعدة لذلك وتقليل الجهد في فحص المستندات وتقسيمها وفقا لموضوعاتها، وكذلك توفير وقت إعلان المدعي عليه أو من يمثله بالدعوى أو بأدلتها أو اطلاعه عليها رقميا لإعداد دفاعه، ويؤدي أيضا إلى تقليل مواعيد الحضور والمسافة المحددة قانونا، وسرعة تحديد الجلسة الأولى لنظر الدعوى والعلم بها من خلال تحديدها آليا، لمنع التلاعب بعدم التدخل للعنصر البشري فيه ذلك، كما يؤدي إلى عدم تعرض مستندات الخصوم إلى ضياعها أو إتلافها أو تزويرها أو على الأقل القدرة على تحديد المسؤول على ذلك أم لا؟. ومن هذا يوجب الأمر التعرف على أبعاد تأثير استخدام التقاضي الإلكتروني عن الحد من الفساد، وإلى أي مدى يؤثر هذا التناول في زيادة وسرعة الفصل في الدعاوى المتداولة أمام القضاء.

The real question arises as to whether the use of electronic litigation means helps reduce and limit corruption by documenting litigants’ requests, defenses, and memorandums in a way that does not allow anyone to tamper with the wording, so no one can delete, add, or abbreviate the phrases contained in any document. In addition, dealing with claimants or representing them remotely (by accessing the court’s digital website) leads to reducing the participation of those who attend the trials, restricting them and following them up on the one hand, and working to save effort among them by knowing the successive measures digitally, which has contributed to reducing the downtime.
