|a للشهادة أمرٌ عظيم؛ فيها حفظ الحقوق لأصحابها، وقد يحتاج القاضي إلى شهادة الصبيان في مسألة تخصهم حين ينفردون؛ فتكون شهادتهم على بعضهم ضرورة خلاف الأصل، وقد تناول الفقهاء مسائل شهادة الصبيان، فوقع الاتفاق في بعض صورها، والاختلاف في أخرى؛ فاتفقوا على أن الصبي المميز يصح تحمله للشهادة، وأنها لا تجوز في الحقوق، والصبي غير المميز لا يصح تحمله ولا أداؤه لها، واختلفوا في حكم قبول شهادة المميزين فيما انفردوا فيه من الجروح والدماء، والراجح قبولها، وهي السنة، وعليه مذاهب السلف، بشروط معتبرة، فإن كانت في الدماء فلا يثبت بها سوى إيجاب الدية؛ دون القصاص؛ لأنه لا يستوفى من غير المكلف.
|b Witness is an important issue for the reservations of people's right. Concerning youngsters' witness, the judge sometimes accepts it for issues concerning youngsters. Scholars have addressed this issue and generally agreed on that, except in issues of rights, a responsible youngster is afforded to witness, whereas an irresponsible is not. For wounds and murders, scholars have disagreed on the rule of accepting even responsible youngsters' witness. However, for most scholars, it is most likely accepted under certain conditions. In case of murder, then a judge is to sentence with Diyah, and not death, as witness is only fulfilled by adults...
