المستخلص: عالجت هذه الدراسة واقع التشريع الإسلامي في شنقيط في القرن الثالث عشر الهجري، مبرزة مظاهر التجديد عند الشيخ محمد المامي الذي يعد من أبرز علماء قطره في هذا القرن، وذلك من خلال إظهار نزعته الاجتهادية، وتفاعله مع جل الأحداث البارزة من حوله، واهتمامه بمعرفة خصائص مجتمعه، وضروراته، ومشكلاته، وتجاوزه لظاهرة الجمود على ظواهر نصوص المدونات الفقهية التي ظلت تصارع العقل الفقهي في القطر الشنقيطي عبر العصور. توصلت الدراسة إلى مجموعة من النتائج أبرزها: تجلت مظاهر التجديد عند الشيخ في حياته العلمية بشكل عام، والتي كانت حياة مغايرة للأنماط الفكرية السائدة في قطره، حيث اتسمت بالروح التجديدية والإصلاحية، والرؤية المعرفية الشمولية، التي تتجاوز النظرة الضيقة، والتقوقع المذهبي؛ وتبنى الشيخ مبدأ ضرورة استمرار التجديد في المجال التشريعي، ليظل محافظا على ملاءمة الواقع المتجدد، وهو ما جعله ينادي بضرورة إحياء الاجتهاد وتفعيله. أوصت الدراسة بمجموعة من التوصيات، أبرزها: ضرورة دراسة المنهج الذي سلكه الشيخ في التجديد الفقهي، فهو حري بالدراسة والتحليل لما يتميز به من مرونة وملامسة لواقع الناس؛ ودراسة مسوغات رفض الشيخ لتطبيق النصوص الفقهية التي أنتجت في بيئات حضرية على مسائل وقضايا سكان البادية.

This study dealt with the reality of Islamic legislation in Chinqeet in the thirteenth century AH, highlighting the manifestations of renewal of Sheikh Muhammad Al-Mami, who is considered one of the most important scholars of his country in this century, by showing his diligent tendency, his interaction with the prominent events around him, his interest in knowing the characteristics of his society, its necessities, its problems, and his transgression of the phenomenon of stagnation on the phenomena of the texts of jurisprudential blogs which have been wrestling with the jurisprudential mind in the Shinqeeti country through the ages. The study reached a set of results, most notably: the manifestations of the sheikh's renewal were manifested in his scientific life in general, which was a life different from the prevailing intellectual patterns in his country, as it was characterized by the renewal and reform spirit, and the comprehensive cognitive vision, which transcends the narrow view, and sectarian isolation; And the sheikh adopted the principle of the necessity of continuing renewal in the legislative field, in order to maintain the suitability of the renewed reality, which is what made him call for the necessity of reviving and activating ijtihad. The study recommended a set of recommendations, the most prominent of which are: the need to study the approach that the sheikh took in jurisprudential renewal, as he is free to study and analyze because of his flexibility and contact with the reality of people; And the study of the justifications for the sheikh's refusal to apply the jurisprudential texts that were produced in urban environments to the issues and issues of the desert population.
