المستخلص: أن التطور الهائل والإحراز المتقدم في عالم تطوير تكنولوجيا الذكاء الاصطناعي، لاسيما عالم بات يشبه الحياة البشرية في أغلب تصرفاتها، جعل النظر إلى استخدامها يعطي انطباعاً بأنها ستكون محركاً للتغيير في المجتمع، والذي بدوره سيساهم في خلق مجتمعات أفضل، وأكثر استدامة وتنمية. فلم يعد يقتصر دور الخوارزميات على مجرد تطوير صناعتها أو إبرازها على الساحة كاختراعات تكنولوجيا فحسب، بل أصبحت النظرة أوسع اتساعاً وتفاؤلاً نحو المستقبل مع إدراجها في حياتنا اليومية. وجعل تصور وجود قاضي آلي بات قريباً، خاصةً مع تحول العديد من محاكم الدول إلى تبني التكنولوجيا الحديثة في العديد من إجراءاتها. إلا أنه ستظل هناك العديد من العقبات التي تواجهنا في حال اعتمدنا بشكل أساسي على وجود تلك التكنولوجيا، دون أن يكون دورنا الأساسي تحريكها بدلاً من أن نخضع لها. الأمر الذي دفعنا للبحث حول طبيعة استخدام تلك الخوارزميات في أنظمة العدالة، واستشراف تصور تطبيق القاضي الروبوت في أروقة المحاكم وأمام المتقاضين. وكيف سيتم صنع القرار القضائي في عهد الخوارزميات، وما إذا كان باستطاعة الآلة المبرمجة أن تحل محل القاضي وتتوافق مع معايير السلوك الأخلاقي والقانوني التي تفرضها طبيعة العمل العدلي. يثير البحث إشكاليات عدة تتمحور حول إشكاليتين رئيسيتين هما: ميل البشر المفرط نحو التفاؤل بإلقاء عبء اتخاذ القرارات التي تمس حياتهم على عاتق وسائل التكنولوجيا. والثانية هي إمكانية الانتقال بمسؤولية اتخاذ القرار القضائي إلى عاتق الآلة. بما في ذلك تحليل مدى مساهمة تلك الخوارزميات في تسريع عملية المعالجة القانونية للقضايا بشكل منصف وفعال. وانتهى البحث لعدد من النتائج كان أبرزها أن البحث في إيجاد فكرة القاضي الروبوت تعد فرصة جيدة لتطور عمليات الذكاء الاصطناعي لدعم القضاة، وعلى الرغم من أنه قد تم إدخال أنظمة الذكاء الاصطناعي في نظم العدالة فعلياً، إلا أنه مازال توجيه تلك النظم يقتصر نحو التحليل القانوني والفني فقط، ويبدو من ذلك أن النظرة الحالية لتلك الأنظمة تقتصر على أن تكون جزءاً من العمل التحليلي الذي يقوم به القاضي البشري، دون أكثر من ذلك.

The tremendous development and progress made in the world of developing artificial intelligence technology, especially a world that has begun to resemble human life in most of its behaviors, has created the expectation it will be the locomotive for change in society, in meaning that it will contribute to creating better, more sustainable and developing societies. The role of algorithms is no longer limited to merely developing their industry or highlighting them on the scene as technological inventions, but the outlook towards the future has become broader and more optimistic with their inclusion in our daily lives. The concept of having an automated judge is imminent, especially with the courts turning to adopting modern technology in many of their procedures. However, there will still be many obstacles facing us if we rely primarily on the existence of this technology, without our primary role being to lead it rather than to submit to it. This prompted us to examine the use of these algorithms in justice systems, and to envision the application of the robot judge in the corridors of courts and before litigants. How will judicial decisions be made in the era of algorithms, and whether a programmed machine can replace the judge and comply with the standards of ethical and legal values imposed by the nature of judicial work. The research raises several problems centered around two main problems: the excessive human tendency towards placing the burden of making decisions that affect their lives on the shoulders of technology. The second is the possibility of transferring the responsibility for making judicial decisions to the machine. Obviously, this study will Including an analysis of the extent to which these algorithms contribute to accelerating the process of legal treatment of cases in a fair and effective manner. The study ended with several results, the most prominent of which was that research encourages the idea of a robot judge as a good opportunity for the development of artificial intelligence processes to support judges. And although artificial intelligence systems have been introduced into justice systems, the field of these systems is still limited to legal and technical analysis. It seems that the current task of these systems is limited to being an assistant to the human judge in the analytical work carried out by this judge, and nothing more than that.
