المستخلص: يبين البحث مفهوم الإشكال عند الفقهاء، بالمعنى الذي يقابل معارضة الفروع لأصول المذهب وقواعده. ثم يبين العلاقة بين هذا المصطلح وألفاظ أخرى مقاربة كالتناقض والاضطراب. كما يبين أهمية الإشكال وعناية العلماء به وضرورته في بناء العلم وتصحيحه. ثم يتطرق إلى بيان أسباب الإشكال التي ترجع في جملتها إلى الالتباس والاشتباه، وذلك عندما يتعارض فرع ثابت النقل عن الإمام مع أصل غير مختلف فيه في المذهب، ويكون التعارض من جهة متحدة، فيقع الإشكال، ثم يبحث الفقهاء في طرق الحل، والتي يمكن أن تكون في تصحيح النقول والتثبت فيها، أو في تأويلها بما يوافق الأصول، أو في بيان الفرق بين المسائل المشكلة وغيرها، أو في تصحيح الفروع بردها إلى الأصول، أو في تخريج الوجوه على نحو يوافق قواعد المذهب. ثم يشرح آثار الإشكال على العلم ذاته، بما فيه من تصحيح العلم وتنقيح العبارات، وتدعيم المذاهب وحراسة أصولها، وإتقان المآخذ وتصحيح البناء عليها، والتنبيه على الأقوال الضعيفة والفاسدة، وإثراء المذاهب بالوجوه والتخريجات، وبما يترتب عليها من لزوم الحذر والتأني في فهم كلام الفقهاء، وتمييز مراتب الفقهاء بعضهم عن بعض.

This research explains the concept of "ishkal" (ambiguity) according to jurists, in the sense of contradictions between branches of Islamic law and the foundational principles and rules of a legal school (madhhab). It clarifies the relationship between this term and other related terms such as contradiction and inconsistency. The research highlights the importance of ishkal, scholars' attention to it, and its necessity in the development and correction of knowledge. The research then discusses the causes of ishkal, which mainly stem from confusion or ambiguity when a transmitted branch from an imam conflicts with an undisputed principle of the school, and the contradiction arises from a unified perspective, leading to the occurrence of ishkal. Jurists then explore ways to resolve these issues, which may include verifying and correcting transmissions, interpreting them in line with foundational principles, distinguishing between ambiguous issues and others, or correcting branches by referring them back to their principles, or extrapolating views in a way that aligns with the rules of the school. The research also explores the effects of ishkal on knowledge itself, including the correction of knowledge, refining expressions, strengthening the legal schools and safeguarding their principles, perfecting the bases for legal rulings, correcting derivations, alerting to weak and invalid opinions, and enriching the legal schools with new perspectives. It also emphasizes the importance of caution and deliberation when interpreting the words of jurists, and distinguishing between the ranks of different jurists.
