|a الإجرام المالي والاقتصادي هو مجموعة الأنشطة غير القانونية التي تستهدف الحصول على مكاسب مالية بطرق غير مشروعة أو التأثير على النظام الاقتصادي بشكل سلبي، وتشمل هذه الجرائم التلاعب في الأسواق المالية، والاحتيال الضريبي، وغسيل الأموال، والتزوير، والرشوة، وسرقة الملكية الفكرية، والتجارة غير المشروعة بالمخدرات والأسلحة. هدا وتعتبر الجرائم المالية والاقتصادية مشكلة كبيرة في العالم، حيث تؤثر سلبا على الاقتصاديات الوطنية والعالمية وتهدد استقرار النظام المالي. نظرا لاعتبارها من سمات القرن العشرين قرن التكنولوجيا والعولمة. من أجل دلك صار التحدي الأساسي في مكافحة هذه الجريمة يكمن في صعوبة كشفها ومعاقبة المتورطين فيها، نظرا لتعقيداتها وتشعبها عبر الحدود الوطنية واستخدام التكنولوجيا في تنفيذها لذا وجب البحث عن سبل التصدي لهذه الجرائم التي تستدعي مكافحة خاصة من حيث التجريم والعقاب ومن حيث الإجراءات الخاصة التي تتلاءم وخصوصيتها.
|b Financial and economic crime encompasses a range of unlawful activities aimed at acquiring financial gains through illegitimate means or negatively impacting the economic system. These crimes include market manipulation, tax fraud, money laundering, forgery, bribery, intellectual property theft, and illicit trade in drugs and weapons. Financial and economic crimes pose a significant global problem, adversely affecting national and global economies and threatening the stability of the financial system, particularly in the era characterized by technological advancement and globalization. Therefore, the primary challenge in combating these crimes lies in the difficulty of detecting and punishing the perpetrators due to their complexities and cross-border nature, along with the utilization of crime in their execution. Hence, it is imperative to explore ways to address these crimes, necessitating specialized measures in terms of criminalization, punishment, and tailored procedures that suit their particularities.
