المستخلص: إن أنظمة الحكم السابقة كانت تتميز بالاستبداد، وإسباغ الواقع باللامساواة في العلاقات بين الأفراد، وتقييد الحريات، والعمل دون إرساء قواعد العدالة، الأمر الذي شغل وعي، وفكر فقهاء القانون على مختلف مدارسهم، على صياغة مضامين العدالة الدستورية بنصوص دستورية نظرا لارتباطها بـ (الفرد، المجتمع، السلطة)، ومنحوا الأفراد حق الطعن حال التعدي على حقوقهم، فهذه العدالة أبصرت النور بعد إن أصبح للدستور قضاء يصدر قراراته وفقا لنصوصه مما لا شك فيه فإن تحقيق العدالة الدستورية تختلف تبعا للرؤى الذي يتبناها النظام السياسي السائد في البلد، فضلا عن اختلاف الثقافات والمعتقدات التي يتبناها المجتمعات، إلا إن المشرعين الدستوريين لمعظم الوثائق الدستورية الديمقراطية المعاصرة، وخاصة الدستور العراقي لسنة 2005م، ركزوا على إن تأتي حقوق الأفراد، وحرياتهم في رأس تراتيب القواعد الدستورية، وبناء على هذه النصوص فإنه في حال التعدي على هذه الحقوق فإن العدالة الدستورية لا تتحقق تلقائيا إلا من خلال الطعن أمام المحكمة الاتحادية العليا في العراق الذي تحكم وفق النصوص الدستورية بغية ضمان حقوق الأفراد، وحرياتهم.

The previous regimes were characterized by tyranny, and the reality of inequality in relations between individuals, and the restriction of freedoms, and work without establishing the rules of justice, which occupied the awareness, and the thought of jurists on their various schools, to formulate the contents of constitutional justice constitutional texts due to their association with (individual, society, authority), and granted individuals the right to appeal in the event of infringement of their rights, this justice saw the light after the constitution became a judiciary that issues its decisions according to its texts. There is no doubt that the achievement of constitutional justice varies according to the visions adopted by the prevailing political system in the country, as well as the different cultures and beliefs adopted by the communities, but the constitutional legislators of most contemporary democratic constitutional documents, especially the Iraqi Constitution of 2005, focused on that the rights of individuals, and their freedoms come at the top of the order of constitutional rules, and based on these texts, in the event of infringement of these rights, constitutional justice is not achieved automatically only through appeal before the court. The Supreme Federation in Iraq, which governs in accordance with the constitutional provisions in order to guarantee the rights and freedoms of individuals.
