|a إن قيام النزاع المسلح يؤدي بالضرورة إلى تعدد الفئات المقاتلة، الأمر الذي يصعب في أغلب الأوقات تحديد الوضع القانوني لبعض المجموعات المشاركة في الأعمال الحربية، فيصعب التمييز بين المقاتل والمدني من جهة، والتمييز بين المقاتل الشرعي والمقاتل غير الشرعي من جهة أخرى، إذ أن هناك من يتخذ من عملية القتال مهنة يتكسب منها كالمرتزقة، ناهيك عن ما للجاسوس من دور في العمليات العدائية وبالتالي يطرح إشكال مدى تمتع هذه الفئات بالحماية القانونية الدولية. وللوقوف على المركز القانوني لهؤلاء الأشخاص نحاول التطرق إلى تحديد المفهوم الإطار القانوني لكلا من المقاتل الشرعي والمقاتل غير الشرعي.
