المستخلص: كان ولا زال التسول ظاهرة اجتماعية ذات آثار اقتصادية واجتماعية وأمنية تعصف بالبلد رغم كل المعالجات والعقوبات القانونية التي وضعها المشرع الوطني لغرض القضاء عليها إلا أن هذه العقوبات لم تحد من انتشار المتسولين في الطرقات بل على العكس من ذلك نجد أن أعمار وفئات المتسولين في تنوع وتجدد في طرق التسول ولا توجد إحصائية للأعداد المتزايدة، وفي وقتنا الحالي لا يقتصر التسول على الأفراد الوطنيين بل نجد أن هنالك أعداد كبيرة من المتسولين الأجانب الذين يتوافدون إلى العراق من البلدان المجاورة بحجج مختلفة وبعد ذلك يلتجاؤن إلى التسول خاصة في ظل غياب الرقابة القانونية الفعالة عليهم، وتتعدد أسباب التسول وقد يعزو البعض في ازدياد ظاهرة التسول إلى وجود جهات وعصابات منظمة تتولى زج المتسولين في الطرقات مستغلة ظروفهم وتقوم بابتزازهم، والأمر الذي يعتبر أحد أنواع الاتجار بالبشر، فضلا عن الأسباب الاقتصادية كالفقر وعجز الحكومات عن وضع خطط لمعالجته ناهيك عن عدم وجود دور لإيواء المتشردين والمتسولين الأمر الذي يدفع الجهات المختصة إلى إطلاق سراحهم لقاء كفالة مالية أو لعدم كفاية الأدلة، وسنبحث في هذه الدراسة أسباب تسول الأجانب وطرق معالجتها، وبحث موقف قانون الأجانب العراقي النافذ من الأجانب الذين يمتهنون التسول بعد خرقهم لشروط الإقامة أو قد يكونون غير حاملين للإقامة المشروعة كما هو عليه الحال بالمهجرين من دولة سوريا والمتواجدين بكثرة في العراق.

On the contrary, we find that the ages and categories of beggars are in diversity and renewal in Methods of begging There are no statistics for the increasing numbers, and at the present time begging is not limited to national individuals, but rather we find that there are large numbers of foreign beggars who flock to Iraq from neighboring countries under various pretexts and then resort to begging, especially in the absence of effective legal control over them, There are many reasons for begging, and some may attribute the increase in the phenomenon of begging to the presence of organized parties and gangs that take beggars on the streets, taking advantage of their conditions and blackmailing them, which is considered one of the types of human trafficking, in addition to economic reasons such as poverty and the inability of governments to develop plans to address it, not to mention the lack of shelters. vagabonds and beggars, which prompts the competent authorities to release them in exchange for a financial guarantee or for lack of evidence, and we will examine in this study the reasons The father of foreigners’ begging and methods of dealing with it, and examining the position of the Iraqi foreigners’ law in effect regarding foreigners who practice begging after violating the conditions of residency, or who may not have legal residency, as is the case with the displaced from the state of Syria, who are abundantly present in Iraq.
