المستخلص: يتفق رأي فقهاء شريعتنا الإسلامية الغراء مع ما تؤكده الحقائق العلمية الصحيحة من وجود توافق وتطابق بين هوية الشخص الجنسية مع حقيقته البيولوجية (حقيقة جنسه) ومن ثم فان أي اضطراب قد يمس هذه الحقائق المتعلقة بالهوية الجنسية من خلال انتهاج تصرفات سلوكية غير سوية (دون وجود أسباب طبية ضرورية) يعد سلوكا شاذا وغير مقبول لا شرعا ولا قانونا يتوجب مواجهته والحد من انتشاره كونه يتنافى مع أساسيات شريعتنا الإسلامية ويؤدي إلى انتشار ظواهر سلبية تؤثر على المجتمع ككل وعلى كيان الأسرة بشكل خاص. ويتولى بحثنا تسليط الضوء على الشذوذ الجنسي المتمثل بسعي بعض الأفراد إلى إقامة علاقات جنسية محرمة دون وجود أي علة خلقية سوى ما يوجد في ذهن ذلك الشخص من إنكار لحقيقته الجنسية وشهوة جنسية غير سوية تطغى عليه فتدفعه إلى محاولة الابتعاد عن أفراد أسرته الحقيقية من خلال قيام الشخص الشاذ بتصرفات تخالف طبيعة جنسه والارتباط بأشخاص من نفس جنسه الأصلي بعلاقة شاذة محرمة، فضلا عن محاولة التنصل عن حقيقته الجنسية غير السوية معتقدا بان ما يقوم به يدخل ضمن نطاق حريته الشخصية، وغالبا ما يكون الشاذ مصابا بأمراض نفسية، أو قد تلعب الإرادة دورا في إبراز ذلك الشذوذ إلى العالم الخارجي، وحاولنا من خلال البحث معرفة راي الشريعة والقانون بذلك التصرف، ومدى وجود الضرورة فيه وهل هذه الضرورة تبيح المحظور المتمثل بتغيير فطرة الله، علما أن هناك أشخاصا يرغبوا بذلك التحول لمجرد التغيير ودون وجود أي مرض مع توضيح اثر الشذوذ في مسائل الأحوال الشخصية.

The jurists of our noble Islamic law agree with what is confirmed by the correct scientific facts that there is a match and compatibility between a person’s sexual identity and his biological reality (the reality of his gender). Therefore, any disorder may affect these facts related to sexual identity through the adoption of abnormal behavioral actions (without the presence of necessary medical reasons). It is considered abnormal and unacceptable behavior by law. It must be confronted and its spread restricted, as it contradicts the basics of our Islamic law and leads to the spread of negative phenomena that affect society as a whole and the family entity in particular. Our research sheds light on homosexuality, which is represented by some individuals seeking to establish forbidden sexual relations without the presence of any moral defect other than what exists in that person’s mind of denial of his sexual reality and an abnormal sexual desire that overwhelms him, causing him to try to distance himself from his real family members through the person’s homosexual acts in behavior that contradicts the nature of his gender and associates with people of the same original gender in a forbidden homosexual relationship, in addition to trying to renounce his abnormal sexual reality, believing that what he does falls within the scope of his freedom. The homosexual is often afflicted with psychological illnesses, or the will may play a role in highlighting that abnormality to the outside world. Through our research to know the opinion of the Sharia and the law regarding this behavior, the extent to which there is necessity in it, and does this necessity permits the forbidden thing represented by changing the nature of God, knowing that there are people who desire that transformation simply for the sake of change and without the presence of any disease while clarifying the effect of the abnormality in matters personal status.
