|b The rapid evolution of digital technologies has fundamentally transformed our conception of identity, shifting from real-world identity to digital identity. Rooted in the proliferation of digital data, this transition poses significant legal challenges, particularly in terms of data ownership, confidentiality, and security. Legal frameworks originally designed for physical realities require careful adaptation to this new digital landscape. Trust in the cyberspace heavily relies on the robustness of digital identity, prompting legal institutions to quickly adjust to ensure effective protection in this constantly evolving environment. This article aims to analyze the legal and institutional framework of digital identity, specifically assessing the effectiveness of Moroccan legislation related to cyberspace, particularly concerning the protection of personal data and digital identity. The objective is to determine whether these legal provisions are adequate to guarantee a strong protection of digital identity in society. To address this issue, we will conduct an in-depth analysis of the protection provided by the Moroccan legislator regarding digital identity through the following axes: The first axis: The conceptual framework of digital identity The second axis: The legal and institutional framework related to digital identity.
|d L'évolution rapide des technologies numériques a transformé fondamentalement notre conception de l'identité, passant de l'identité réelle à l'identité numérique. Ancrée dans la prolifération des données numériques, cette transition pose d'importants défis juridiques, notamment en matière de propriété, confidentialité et sécurité des données. Les cadres légaux conçus pour des réalités physiques nécessitent une adaptation minutieuse à cette nouvelle réalité numérique. La confiance dans le cyberespace dépend fortement de la robustesse de l'identité numérique, incitant les institutions légales à s'ajuster rapidement pour assurer une protection efficace dans cet environnement en constante évolution. Cet article se propose d'analyser le cadre juridique et institutionnel de l'identité numérique, en évaluant spécifiquement l'efficacité de la législation marocaine relative au cyberespace, notamment en matière de protection des données personnelles et de l'identité numérique. L'objectif est de déterminer si ces dispositions légales sont adéquates pour garantir une protection solide de l'identité numérique dans la société. Pour aborder cette problématique, nous procéderons à une analyse approfondie de la protection offerte par le législateur Marocain en matière d'identité numérique, à travers les axes suivants: Le premier axe: Le cadre conceptuelle de l’identité numérique Le deuxième axe: Le cadre juridique et institutionnel relative à l’identité numérique.
