المستخلص: نحاول من خلال هذه الدراسة تبيان أهم الإشكالات التي تعترض سبيل التعاون الدولي في مجال تسليم المجرمين، إذ يعد هذا الأخير من أهم صور التعاون القضائي الدولي من أجل مكافحة الجريمة المنظمة وملاحقة مرتكبيها حتى لا يفلتوا من العقاب وخاصة ونحن في زمن تعددت فيه أصناف الإجرام ووسائل ارتكابه وسرعة انتشاره وسهولة تنفيذه، مما يحتم على أعضاء المجتمع الدولي التنسيق واعطاء أهمية لهده الآلية التي أصبحت مطلبا حتميا في مجابهة الجريمة وتعقب مرتكبيها، ذلك أن ظاهرة الإجرام في استفحال كبير وتطور في وسائل ارتكابه مما يستدعي الأمر التزام أكثر من قبل الدول بهدف التضييق على المجرمين، كما أن هذا المبدأ يعد اليوم حتمية أساسية فرضتها مقتضيات العصر الحالي الذي تنامي فيه الإجرام بشكل سريع أكثر من السابق، وعلى هذا الأساس أصبح مطلب جل الدول ومنها الجزائر بضرورة تنسيق أكثر في تحديد الأسباب التي ساهمت في انتشار الجريمة وتنوعها ومن تم تحديد الوسيلة الأنسب لمكافحتها في إطار قواعد القانون الدولي، وعليه سوف نقوم من خلال هذه الدراسة على إبراز مجال أعمال مبدأ تسليم المجرمين وشروطه والإجراءات المتبعة بشأنه، وكذا الصعوبات التي تواجه تنفيذ هذه الآلية في إطار مكافحة الجريمة وتسليم مرتكبيها.

Through this study, we are trying to clarify the most important problems that hinder international cooperation in the field of extradition, as the latter is one of the most important forms of international judicial cooperation in order to combat organized crime and prosecute its perpetrators so that they do not escape punishment, especially as we are in a time when there are many types of crime and the means of committing it, the speed of its spread and ease of implementation, which necessitates the members of the international community to coordinate and give importance to this mechanism, which has become an imperative requirement in confronting crime and tracking down its perpetrators. The phenomenon of crime is on a significant increase and development in the means of committing it, which requires more commitment by states in order to restrict criminals, and this principle is today a basic imperative imposed by the requirements of the current era, in which crime has grown more rapidly than before, and on this basis, the demand of most countries, including Algeria, has become the need for more coordination in identifying the causes that contributed to the spread and diversity of crime, and the most appropriate means to combat it have been determined within the framework of the rules of international law, and accordingly Through this study, we will highlight the scope of the extradition principle, its conditions and procedures, as well as the difficulties facing the implementation of this mechanism in the framework of combating crime and extradition of perpetrators.
