المستخلص: إن الإجماع مصدر من مصادر التشريع الإسلامي، وإليه يرجع في الأحكام الفقهية، وهو سبيل المؤمنين الذي لا ضلالة فيه، من زاغ عنه ضل عن الحق، قال تعالى: (ومن يشاقق الرسول من بعد ما تبين له الهدى ويتبع غير سبيل المؤمنين نوله ما تولى ونصله جهنم وساءت مصيرا). "النساء، آية ١١٥". ومن مباحث الإجماع المهمة، صيغه وألفاظه، وفي هذا البحث سأتكلم عن تأثير هذه الصيغ في حصول الإجماع من عدمه، واخترت أن يكون عنوان هذا البحث هو: "أثر اختلاف صيغ الإجماع عند ابن قدامة من خلال كتابه المغني من كتاب الصيام". وهدفي من هذا البحث سرد هذه المسائل وذكر نص ابن قدامة فيها، وبيان هل هي مجمع عليها أو لا؟، للوصول إلى تأثير اختلاف صيغ الإجماع من حيث الاعتبار وعدمه، والذي قد كان سبباً في اختلاف الحكم في هذه المسائل من حيث وجود الإجماع عليها أو لا؟.

Consensus is a source of Islamic legislation, and it is referred to in jurisprudential rulings, and it is the path of the believers in which there is no misguidance, whoever deviates from it has strayed from the truth, God Almighty said: (And whoever contradicts the Messenger after guidance has become clear to him and follows other than the way of the believers- We will give him what he has taken and drive him into Hell, and evil it is as a destination.) "An-Nisa, verse 115". One of the important topics of consensus is its formulas and words, and in this research I will talk about the impact of these formulas on the occurrence of consensus or not, and I chose the title of this research to be: "The impact of the different formulas of consensus according to Ibn Qudamah through his book Al-Mughni from the Book of Fasting". My aim in this research is to list these issues and mention Ibn Qudamah’s text on them, and to clarify whether they are agreed upon or not, in order to reach the effect of the difference in the formulas of consensus in terms of consideration and lack thereof, which may have been a reason for the difference in the ruling on these issues in terms of the existence of consensus on them or not.
