|a يهدف هذا البحث إلى إلقاء الضوء على المؤثرات الفقهية في فتاوي العلامة علي الخفيف في مجال المعاملات المالية الحديثة، وذلك من خلال دراسة خاصة بشهادة الاستثمار وعقد التأمين، كنموذجين للمعاملات المالية التي أثارت جدلا فقهيا، وكذا تحديد إسهام العلامة على الخفيف في تجديد الفقه الإسلامي، وقد استعنت في إعداد هذا البحث بالمنهج الوصفي التحليلي؛ حيث حللت فتاوي العلامة على الخفيف الخاصة بشهادة الاستثمار وعقد التأمين وذلك من خلال دراسة أسانيده الفقهية، وبيان مبرراته الفقهية، وقد توصل البحث إلى مجموعة من النتائج ومنها: أن فتاوي العلامة على الخفيف في شهادة الاستثمار وعقد التأمين قد تأثرت بشكل كبير بعدد من المؤثرات منها: مدرسة القضاء التي شكلت المصدر الأساسي لفقه العلامة على الخفيف؛ حيث اعتمد على كتبها ومراجعها في استنباط الأحكام الشرعية، ومنها: المقاصد الشرعية فقد ركز العلامة الخفيف على تحقيق المقاصد الشرعية من الأحكام الشرعية؛ مما جعل فتاويه تهدف إلى تحقيق مصالح العباد، وقد أكدت الدراسة حرص العلامة على الخفيف على تحقيق التوازن بين مصلحة الفرد والمصلحة العامة عند إصدار فتاويه؛ حيث حرص على الموازنة بين النصوص الشرعية والواقع المعاصر، مع مراعاة مصالح المشاركين في هذه المعاملات؛ مما جعله مرجعا موثوقا يعتمد عليه في مختلف المعاملات المالية. كما أثبتت الدراسة أن فتاوى العلامة على الخفيف أسهمت في إرساء قواعد فقهية راسخة لتنظيم المعاملات المالية الحديثة؛ مما أفاد المسلمين في مختلف أنحاء العالم عند التعامل مع شهادة الاستثمار وعقد التأمين.
|b This research aims to shed light on the jurisprudential influences in the fatwas of the mark Ali Al-Khafif in the field of modern financial transactions, through a special study of the investment certificate and the insurance contract, as two models of financial transactions that have sparked jurisprudential controversy, as well as to determine the contribution of the mark Ali Al-Khafif in the renewal of Islamic jurisprudence, and I used in the preparation of this research the descriptive analytical approach, where the fatwas of the mark Ali Al-Khafif were analyzed for the investment certificate and the insurance contract through the study of its bases Jurisprudence, and a statement of its jurisprudential justifications. The research reached a set of results, including: The fatwas of the scholar Ali Al- Khafif in the investment certificate and the insurance contract have been greatly affected by a number of influences, including:- The School of Justice, which formed the main source of the jurisprudence of the scholar Ali Al-Khafif, as he relied on its books and references in deriving legal rulings The study confirmed the keenness of the scholar Ali Al-Khafif to achieve a balance between the interest of the individual and the public interest when issuing his fatwas, as he was keen to balance between the legal texts and contemporary reality, taking into account the interests of the participants in these transactions, which made him a reliable reference to rely on in various financial transactions. Ali Al-Khafif contributed to establishing solid jurisprudential rules to regulate modern financial transactions, which benefited Muslims around the world when dealing with the investment certificate and insurance contract.
