المستخلص: الهدف من هذا البحث يكمن في محاولة التعرف على جريمة نشر الشائعات عبر مواقع التواصل الاجتماعي وهذا من خلال المقارنة بين كل من المشرع الإماراتي والسعودي، وذلك ببيان مفهوم نشر الشائعات عبر مواقع التواصل الاجتماعي، مع إيضاح أنواعها المتعددة، وذكر أبرز خصائص وأهداف نشر الشائعات عبر مواقع التواصل الاجتماعي، وأيضا بيان الأركان الأساسية التي تقوم عليها جريمة نشر الشائعات عبر مواقع التواصل الاجتماعي، مع تحديد العقوبات المقررة على مرتكبين هذه الجريمة في كل من المنظم السعودي والمشرع الإماراتي، ومع إيضاح سبل مكافحتها. وتم التوصل من هذا البحث لنتائج عدة ومن أهمها، أن الركن المادي لجريمة نشر الشائعات عبر مواقع التواصل الاجتماعي تعتبر من الجرائم التعبيرية التي قد تتم بنشر صورا وفيديوهات أو كتابة أو رسوم، ويشترط أن يقوم ناشر الشائعات عبر مواقع التواصل الاجتماعي بكتابة أمر معين ونشره لعموم المتلقين لهذه المعلومة أو الخبر، وأن كلا من المنظم السعودي والإماراتي اعتبروها من الجرائم الشكلية، بالإضافة إلى أن الركن المعنوي في جريمة نشر الشائعات عبر مواقع التواصل الاجتماعي يعتبر من الجرائم العمدية الذي اشترط المنظم السعودي والمشرع الإماراتي توفر القصد الجنائي العام بعنصريه وهي علم ناشر الشائعات وإرادته الإجرامية من ارتكاب الفعل، وقد توصلت من هذا البحث إلى توصيات ومن أهمها، مناشدة المنظم السعودي أن يقوم بوضع نصا خاص متعلق بجريمة نشر الشائعات عبر مواقع التواصل الاجتماعي ويحدد به الأفعال التي يتخذها ناشر الشائعات عند قيامهم بهذه الجريمة.

The aim of this research lies in trying to identify the crime of spreading rumors through social networking sites and this is through a comparison between both the Emirati and Saudi legislators, by explaining the concept of spreading rumors through social networking sites, with an explanation of their multiple types, and mentioning the most prominent characteristics and objectives of spreading rumors through social networking sites, as well as a statement of the basic pillars on which the crime of spreading rumors through social networking sites is based, with the penalties prescribed for the perpetrators of this crime in each of the The Saudi regulator and the UAE legislator, and with an explanation of ways to combat them Several results were reached from this research, the most important of which is that the material element of the crime of spreading rumors through social networking sites is considered one of the expressive crimes that may be carried out by publishing pictures, videos, writing or drawings, and it is required that the publisher of rumors through social networking sites write a certain order and publish it to the general recipients of this information or news, and that both the Saudi and Emirati organizers considered it a formal crime, in addition to that the moral element in the crime of spreading rumors through social networking sites It is considered one of the intentional crimes that the Saudi regulator and the UAE legislator stipulated the availability of the general criminal intent with its elements, which is the knowledge of the rumor publisher and his criminal will to commit the act, and has reached from this research recommendations, the most important of which is the appeal to the Saudi regulator to develop a special text related to the crime of spreading rumors through social networking sites and specifying the acts taken by the rumor publisher when they commit this crime.
