|a شهد الواقع العملي في الجزائر ظاهرة سلبية تتمثل في كثرة التعدي على أراضي الدولة بطريقة غير قانونية، وهذا من خلال حيازتها أو تشييد مباني ومنشآت عليها، وهو ما أدى إلى تدهور الحظيرة العقارية للدولة؛ ولمعالجة هذه الظاهرة حصن المشرع الجزائري أراضي الدولة بجدار من الحماية التشريعية من خلال سن القانون رقم: 23- 18 المتعلق بحماية أراضي الدولة والمحافظة عليها، ولقد هدفت هذه الدراسة إلى إبراز أهم الوسائل والآليات التي تطرق لها المشرع الجزائري في القانون: 23-18 من أجل الحد من ظاهرة التعدي على عقارات الدولة والمحافظة عليها.
|b The practical reality in Algeria has witnessed a negative phenomenon, which is the frequent encroachment on state lands in an illegal manner, whether through possession or construction of buildings and facilities on them. This has led to the deterioration of the state's property stock. To address this phenomenon, the Algerian legislator fortified state lands and their security with a legislative protection barrier in order to prevent all forms of encroachment. This led to the enactment of Law 23-18 related to the protection and preservation of state lands, indicating the importance of state lands as an integral part of the public wealth of the state. This study aimed to highlight the most important measures, means, and mechanisms addressed by the Algerian legislator through Law 23-18 related to the protection of state lands in order to reduce the phenomenon of encroachment on state properties.
