|a تعد حيازة حقوق الملكية الفكرية من أسباب التطور العلمي والتكنولوجي، باعتبارها أحد أهم الموارد الاستراتيجية التي يعتمد عليها لبناء اقتصاديات متطورة، فهي نتاج فكري يرد على أشياء غير مادية أدبية وصناعية، وكان لظهور هذه الحقوق أثر للتصدي للمعتدين عليها وأصبح لها الفضل الكبير في حماية سلب حقوقهم نهبا وبشكل علني، غير أن المنظمة العالمية للملكية الفكرية توصلت من خلال الواقع العملي أنه بالرغم من وجود ترسانة تشريعية داخل الدول الأعضاء فيها إلا أن هناك بعض المظاهر التي تشكل صورا من صور الاعتداء على حقوق الملكية الفكرية كالتقليد وبوابتها الحدود الوطنية وهنا برزت ضرورة وجود جهاز يلعب دورا مهما في رصد هذه الأعمال وتم التوصل إلى أن إدارة الجمارك هي الجهاز الوحيد القادر والأقدر على تطبيق التدابير الوقائية المتمثلة في توقيف وضبط السلع الحاملة لتلك الحقوق، والتي قد تنطوي عليها اعتداءات سافرة على حقوق أصحابها الأصليين.
|b The acquisition of intellectual property rights is one of the causes of scientific and technological development, as one of the most important strategic resources on which to build advanced economies. It is an intellectual product that responds to non-physical, literary and industrial objects. The emergence of these rights has had an impact on the victims and has greatly helped to protect the innovators from publicly and publicly usurping their rights. However, the World Intellectual Property Organization (WIPO) has, in practice, found that, despite the existence of a legislative arsenal within its member States, there are some manifestations of an attack on intellectual property rights, such as forgery, tradition and national borders. Here, it has emerged that there is a need for a body that plays an important role in monitoring these actions. It has been concluded that the Customs Administration is the only one that can and can apply preventive measures to arrest and seize goods carrying those rights, which may involve flagrant attacks on the rights of their original owners
