The establishment of the International Criminal Court (ICC) aims to effectively combat impunity and uphold justice and the rule of law. For the ICC to function optimally, it needs broad adherence to its statutes, especially since it lacks universal jurisdiction. The United States has used Article 98 of the Rome Statute—which respects national sovereignty and principles of the UN Charter like free consent and good faith—to avoid legal accountability. This inquiry examines the legitimacy of the U.S. using Article 98 to negotiate exemption agreements, exploring their impact on international justice and the ICC's mission, and assessing their consistency with the Rome Statute's goals. |
