The United States has used Article 98 of the Rome Statute—which respects national sovereignty and principles of the UN Charter like free consent and good faith—to avoid legal accountability. This inquiry examines the legitimacy of the U.S. using Article 98 to negotiate exemption agreements, exploring their impact on international justice and the ICC's mission, and assessing their consistency with the Rome Statute's goals. |
