|b The Algerian legal framework mandates the registration of opening petitions for real estate claims and judicial decisions at the real estate registry. Despite this requirement, the process of depositing and registering these documents encounters several challenges. These include the refusal of the real estate registrar to accept deposits from notaries or legally qualified individuals. Failure to register the petition may be attributed to a deficiency in documentation or inadequate information, while difficulties in registering judicial decisions often arise from judges not specifying the expert's tasks clearly or the expert failing to perform adequately. Additionally, complications may occur due to notaries improperly detailing the judicial decision or the ambiguous language used in these decisions. The roles of judges, notaries, and legally qualified individuals are crucial in addressing and preempting these challenges, as the judge can monitor the expert’s performance and ensure clarity, thereby preventing oversights that might affect property designations or the identities of its current and former owners.
