|a إن النساء عانت ولا تزال تعاني من تعرضهن لأبشع صور الانتهاكات الجسدية والجنسية خلال النزاعات المسلحة على مرأى ومسمع من أعضاء المجتمع الدولي؛ على الرغم من وجود عدد من القواعد القانونية الدولية التي تعد الأساس الدولي لتوفير الحماية للنساء في ظل النزاعات المسلحة وآليات وسبل توفير الحماية لهن لما يتعرض له من انتهاكات منظمة وممنهجه من أطراف النزاع من أجل تحقيق انتصارات عسكرية أو معنوية أو أيدولوجية أو تغيير في التركيبة السكانية للأقاليم المتنازعة؛ فنتيجة للصراع يدفع النساء الثمن جراء ذلك بصور عديدة من بينها القتل والإصابة والامتهان والعنف الجنسي والاغتصاب والإجبار على الحمل والإجهاض؛ لذلك سعي المجتمع الدول من خلال اتفاقية جينيف وبروتوكولاتها لعمل على توفير الحماية للنساء والتجريم لشتي أنماط التعدي عليهن أثناء النزاعات المسلحة وكذا توفير الحماية من خلال الدور الذي يؤديه القضاء الدولي لمعاقبة المجرمين الدوليين المنتهكين لحقوق النساء أثناء المنازعات الدولية.

Despite the existence of a number of international legal rules that are the international basis for providing protection for women in the context of armed conflicts and the mechanisms and ways to provide them with protection because they are subjected to the systematic and systematic violations of the parties to the conflict in order to achieve military, moral or ideological victories or a change in the demographics of the regions disputing; As a result of the conflict, women pay the price in many ways, including murder, injury, abuse, sexual violence, rape, forced pregnancy and abortion; Therefore, the international community has sought, through the Geneva Convention and its protocols, to work towards providing protection for women and criminalizing various types of abuse during armed conflicts, as well as providing protection through the role played by the international judiciary to punish international criminals who violate women’s rights during international disputes.
