|a عقد الإبضاع هو إعطاء شخص لآخر رأس مال على أن يكون جميع الربح عائداً له، منهجنا في هذه الدراسة منهج الوصفي - التحليلي من منظر الفقه ومن النتائج التي وصلت إليها الدراسة هي أن الشرع قد أجاز هذا العقد بشرط رضا الطرفان ويسمى رأس المال بضاعة، والمعطي المبضع، والآخذ المستبضع.
|b A contract of goods applies where someone gives money to another for business without the agent having interest or share in the resulting profit. The present study, which was carried out in a descriptive-analytical way, examines the marriage contract from the point of view of jurisprudence. The results of the research indicate that the terms of the contract are permissible, which are achieved by request and acceptance. The contract is made under the possession of the demander and the acceptor composes the form of acceptance. Three pillars: capital (commodity), investor (mustabaza), and a person who engages in business and trade (mustabaza); The pillars form this contract and the verses and traditions prove its legitimacy.
