|a لقد جعل الله تعالى الإسلام منهجا شاملا لحياة الإنسان على المستويين الفردي والجماعي، ويحتوي على قواعد وضوابط تجعله مناسبا لحياة الإنسان في جميع الأوقات والأعمار، مهما تطورت الحياة أو تغيرت الظروف. ويضع الفقه الإسلامي القواعد المتعلقة بمبادئ الحقوق الدولية في العلاقات الإنسانية الدولية في زمن السلم والحرب من خلال التشريعات التي تسن بين الدول. ولما كان الإسلام دينا يرحم فيه الله تعالى جميع أهل الأرض، فإن الشريعة الإسلامية تدور حول عدم تكليف الناس بأشياء تفوق قدراتهم وإمكاناتهم أو لا تدخل في صلاحياتهم، وتقيم التفويض قدر المستطاع. قواعد في قوله تعالى: (لَا يُكَلِّفُ ٱللَّهُ نَفۡسًا إِلَّا وُسۡعَهَاۚ) (البقرة: ٢٨٦)، إن حقوق الإنسان في الإسلام كثيرة، وقد وردت صور الحقوق في الشريعة الإسلامية على شكل أوامر أو نواه من الله سبحانه وتعالى مما يؤكد التوازن بين الحقوق والواجبات لدى الأفراد.
|b God Almighty has established the Islam as a comprehensive approach to human life at the individual and group levels. It contains rules and controls which make it suitable for human life at all times and ages, how life develops or circumstances change. The Islamic Fiqh sets rules related to the principles of the international rights in international human relations in times of peace and war through legislations enacted between states. Since the Islam is a religion in which God Almighty has mercy on all who are on earth, the Islamic law deals with not entrusting people with things that exceed their abilities and capabilities or that do not interfere within their powers, and it values delegation as possible, as in the Almighty's saying,(God does not burden a soul with more than it can bear)," Al-Baqarah 286". There are many human rights in Islam. The images of rights came in Islamic law as commands or alarms by God the Almighty that confirms the balance between rights and duties among individuals.
