المستخلص: من المعلوم أن هناك عدة طرق لتنفيذ العقد الإداري، وتختلف هذه الطرق بحسب موضوع العقد، فإذا كان موضوع العقد مثلا نقلا أو توريدا، فإن الغالب تنفيذها دفعة واحدة، وذلك بمبلغ مقطوع واحد، أما إذا كان العقد الإداري بناء أو صيانة أو نحوهما، فإن الغالب تنفيذها على أساس دفعات متفرقة، ولم يكن الإشكال في المفهوم العام لعقد المقطوعية، بل كان الإشكال في عدم التفرقة بين هذا العقد، والعقود الأخرى التي تتشابه معه مثل عقد تسليم المفتاح؛ ومن هنا جاء هذا البحث ليفرق بينهما، ويبين أيضاً الأعمال والمشتريات الحكومية التي يمكن تنفيذها من خلال عقد المقطوعية الإداري، ويبين أيضاً تكييف هذا العقد قانونياً وفقهياً. يهدف البحث إلى: التعريف بعقد المقطوعية الإداري، وبيان الفرق بينه وبين عقد تسليم المفتاح. تحديد الأعمال والمشاريع الحكومية التي يمكن للجهات الإدارية تنفيذها من خلال عقد المقطوعية الإداري. بيان التكييف القانوني والفقهي لعقد المقطوعية الإداري. منهج البحث: اتبعت المنهج التحليلي التأصيلي، وذلك عند تناولي موضوعات هذا البحث، متبعا الإجراءات التالية: سأقوم ببيان مفهوم عقد المقطوعية الإداري لغوياً، ثم أبينه في اصطلاح القانونيين، ثم أبينه في نظام المنافسات والمشتريات الحكومية السعودي. سأبين الأعمال والمشاريع الحكومية التي يمكن تنفيذها عن طريق عقد المقطوعية عند القانونيين، ثم في نظام المنافسات والمشتريات الحكومية السعودي. سأبين التكييف القانوني والفقهي لعقد المقطوعية الإداري، ملتزماً في كل ما سبق بيانه بالمنهج الموضوعي الدقيق، وتحري الدقة في النقل من الكتب الأصلية والمعتمدة.

It is known that there are several ways to conclude an executive and they differ according to the type of contract. Statement of the legal and jurisprudential adaptation of the administrative lump sum contract. Research Methodology: I followed the original analytical approach when dealing with the topics of this research, following the following procedures: I will explain the concept of the administrative lump sum contract linguistically, then explain it in the jurists’ terminology, then explain it in the Saudi government competitions and procurement system. I will explain the government works and projects that can be implemented through a lump sum contract with legal experts, and then in the Saudi government competitions and procurement system. I will explain the legal and jurisprudential adaptation of the administrative contract of deduction, adhering in all of what was previously explained to the precise objective approach, and ensuring accuracy in quoting from the original and approved books.
