|a ظهرت مخاوف عدة من كثرة استخدام هذه الأجهزة ومدى تأثير ذلك على صحة الإنسان وسلامته، إذ أكدت الدراسات انبعاث الإشعاعات غير المؤينة عن أبراج بث خدمتها، وطبيعة هذه الأشعة كهرومغناطيسية ذات ترددات واطئة، وذلك لعدم مطابقتها للمعايير التي تراعي هذا الجانب. ولقد تنبه المشرع إلى خطورة الإشعاعات غير المؤينة المنبعثة عن تلك المصادر والأضرار الناجمة عنها، فعالج الموضوع في جوانب المسؤولية المدنية، غير أن المشرع لم يعالج هذه المسألة جنائيا فيثار التساؤل عن إمكانية معالجة الموضوع جنائيا في ظل غياب الدور التشريعي؟ خاصة مع تنامي الاستثمار الهائل في مجال الاتصالات وما يحدثه من مخاطر على الصحة.

The legislator was alerted to the danger of non-ionizing radiation emitted from these sources and the damages resulting from them, so he dealt with the issue in aspects of civil liability, but the legislator did not treat this issue criminally, so the question arises about the possibility of treating the issue criminally in the absence of the legislative role? Especially with the growing huge investment in the field of communications and the risks it poses to health.
