|a بالرغم من أهمية الدور الاجتماعي والإنساني الذي يلعبه الطبيب في معالجة المرضى من أسقامهم، إلا أنه في بعض الحالات يمكن أن تلحق المريض أضرار من جراء أخطاء طبية تكون من طرفه أو طاقمه المساعد نتيجة لحساسية ودقة تنفيذ بعض التدخلات الطبية وللصعوبات الملازمة لبعض العمليات الجراحية. هذه الأخطاء الطبية ينجر عنها أضرار مادية ومعنوية تلحق المريض وتكون موجبة للتعويض لجبر ضرره أو التقليل منه، وهذا بعد التأكد من توافر عناصر المسؤولية المدنية للطبيب أو المستشفى العام، والتي يحكم على أساسها القاضي بالتعويض المناسب للضرر الواقع. ويخضع تحديد قيمة التعويض للسلطة الواسعة للقاضي التي تحكمها مجموعة من الضوابط والمعايير القانونية.
|b Despite the importance of the social and humanitarian role that a doctor plays in treating patients from their ailments, in some cases, patients can suffer harm due to medical errors made by the doctor or their assisting staff, These medical errors lead to material and moral damages inflicted on the patient, which necessitates compensation to remedy or mitigate the harm, this is after ensuring the presence of the elements of civil liability of the doctor or the public hospital, based on which the judge rules on the appropriate compensation for the incurred damage. The determination of the compensation amount is subject to the broad authority of the judge, who estimates it based on a set of legal controls and standards.
