|a إن أهمية مبدأ الشفافية في ضوء القانون 23-12 المحدد للقواعد العامة المتعلقة بالصفقات العمومية لا يمكن حصر جوانبه، ذلك أن مكانته هذه مستمدة أساسا من كونه أحد مقومات الحكم الراشد، وأحد آليات مكافحة الفساد علاوة على كونه أحد أهم الدعائم التي تقوم عليها التنمية الشاملة والمستدامة. وبناء على ما سبق فإن تجسيد هذا المبدأ يتطلب من جهة بذل جهد كبير من قبل المشرع الجزائري من خلال سن نصوص قانونية تفرض تطبيقه على الوجه المطلوب، ومن جهة أخرى تكريسه من طرف المصلحة المتعاقدة خلال مختلف مراحل إبرام الصفقات العمومية، بما يضمن بعث الثقة بين المصالح المتعاقدة وبين المتعاملين الاقتصاديين، ويحد من ظاهرة الفساد ويحمي المال العام.
|b The importance of the principle of transparency in light of Law 23-12 specifying the general rules relating to public procurement cannot be limited to its aspects, as its status derives mainly from it being one of the components of good governance, and one of the anti-corruption mechanisms, in addition to being one of the most important pillars on which comprehensive development is based. And sustainable. Based on the above, embodying this principle requires, on the one hand, a great effort by the Algerian legislator by enacting legal texts that impose its application in the required manner, and on the other hand, enshrining it by the contracting authority during the various stages of concluding public contracts, in a way that ensures the establishment of confidence between the contracting interests and economic operators, reduces the phenomenon of corruption and protects public money.
