المستخلص: النظام الديمقراطي هو ذلك النظام الذي يتولى فيه رئيس الدولة منصبه عن طريق الانتخاب سواء كان انتخاب مباشر من الشعب أو بواسطة هيئة متخصصة بذلك، بحيث يكون للأفراد الذين يتوافر فيهم شروط الترشيح لهذا المنصب الحق في ذلك والوصول إليه طبقا للأغلبية المتطلبة في هذا الصدد دون أن يكون لشخص معين أي حق ذاتي في تولي منصب رئاسة الجمهورية، ومما لا شك فيه أن هذه الشروط تحدد من قبل المشرع ليتناسب مع من يتسنم هذا المنصب المهم في الدولة. وبالرغم من أن رئيس الجمهورية يتمتع بدور فاعل ومؤثر في النظم البرلمانية والمختلطة لكن هذا الدور يتباين من نظام سياسي لآخر وذلك بفعل اختلاف آليات تشكيلها واختصاصاتها، كما يتأثر هذا الدور بمعطيات أخرى. على ذلك فإنه في الوقت تتشابه إلى حد كبير شروط مرشح رئيس الجمهورية واختياره في كل من البلدان ذات النظم البرلمانية أو المختلطة لكننا نجد في الوقت نفسه هنالك تباين في دور رئيس الجمهورية في تلك الأنظمة وشروط الترشح لهذا المنصب وذلك بفعل معطيات سياسية ودستورية.

The democratic system is the system in which the head of state assumes his position through election, whether direct election by the people or by a specialized body, so that individuals who meet the conditions for nomination for this position have the right to do so and reach it according to the required majority in this regard without a specific person having any personal right to assume the position of President of the Republic. There is no doubt that these conditions are determined by the legislator to suit those who assume this important position in the state. Although the President of the Republic enjoys an effective and influential role in parliamentary and mixed systems, this role varies from one political system to another due to the difference in the mechanisms of their formation and their powers, and this role is also affected by other factors. Therefore, at the same time, the conditions for the candidate for the President of the Republic and his selection are very similar in all countries with parliamentary or mixed systems, but at the same time we find that there is a difference in the role of the President of the Republic in those systems and the conditions for candidacy for this position due to political and constitutional factors.
