|a المقال تناول التعبد والتعليل في زكاة الفطر، وهذه من المسائل التي اختلفت فيها أنظار الفقهاء فمنهم من غلب فيها جهة التعبد على التعليل فأعمل لظاهر النص في أغلب أحكامها ومنهم من غلب جهة التعليل فراعى المقاصد المرجوة من تشريعها وبعد النظر والبحث خلص الباحث إلى أن الراجح فيها هو التعليل، ورتب على ذلك أحكاما تطبيقية منها جواز إخراجها قيمة إذا كان ذلك أيسر للمزكي وأصلح للفقير، وبيان جواز تعجيلها قبل وقتها للمصلحة، ونقلها إلى بلد غير البلد التي أخرجت فيه للضرورة والحاجة.
|b The study deals with "zakat al fitr", and the controversy that has erupted as for its application. In fact, the debate has long swing between two distinct views. Some scholars see this alms giving as an obligatory donation that should be provided to the needy people in one’s surroundings, while others, more flexible regard it as a religious act of assistance destined to destitute people, wherever they exist. On that premise, they argue that zakat al fitr can be given in money or food items according to the situation of the needy, stressing its transfer to other areas if need be, along with its anticipation, that is to say, before Eid al fitr. Henee, the study in question, confirms the latter opinion since it takes into account the dire need of people who are in abject poverty, relying on argumentation without referring to this poor relief as a mere religious act.
