|a تعد مسألة إسناد الحضانة في الزواج المختلط حال اختلاف الدين ودراستها وتكييفها من الجانب الفقهي والقانوني من أهم وأدق المواضيع القانونية والفقهية لاسيما في عصرنا الحالي الذي انتشر فيه الزواج المختلط بشكل غير مسبوق، وقد كان للفقه الإسلامي نصيب كبير في تكييف هذه المسألة بالنظر إلى الاجتهادات الفقهية السالفة والحديثة، يقابله فراغ تشريعي من طرف المشرع الجزائري الذي قصر في هذا الموضوع ولم يخصص له نصوص قانونية محددة واضحة، إلا أن الاجتهادات القضائية ساهمت بشكل كبير في تغطية هذا التقصير وهذا الفراغ من خلال قراراتها الإيجابية والفعالة.
|b The issue of assigning custody in cases of mixed marriages with religious differences, and its analysis and interpretation from a jurisprudential and legal perspective, is one of the most important and sensitive legal and jurisprudential topics, especially in our current era where mixed marriages have become more prevalent than ever before. Islamic jurisprudence has played a significant role in shaping this issue, considering both past and contemporary jurisprudential efforts. In contrast, the Algerian legislator has left a legislative gap by not providing specific, clear legal provisions on the matter. However, judicial efforts have played a crucial role in covering this shortcoming and gap through their positive and effective rulings.
