|a يهدف هذا البحث إلى بيان النظرة الشرعية لإحدى النوازل المعاصرة في المجال الطبي التجميلي والتي تقوم على استخدام تقنية الكاموفلاج (Camouflage)، وتسليط الضوء على شروط وضوابط جوازها، وحكم إزالة آثارها إذا ترتب عليها نتائج سلبية. وقد اقتضت طبيعة هذا البحث أن أسلك المنهج الاستقرائي والتحليلي: وذلك من خلال تتبع المادة العلمية المتعلقة بموضوع التجميل بتقنية الكاموفلاج (Camouflage) من مظانها، وتحليلها وجمعها وتوزيعها على كل جزئية من جزئيات الدراسة، والمنهج المقارن: من خلال المقارنة بين آراء الفقهاء في المذاهب الأربعة في المسائل الفقهية المتعلقة بموضوع البحث. وتوصل البحث إلى أنه يجوز التجميل بتقنية الكاموفلاج (Camouflage) إذا كان بهدف إخفاء عيوب البشرة أو تحسين شكلها بجعلها أقل وضوحا، كتغطية التشوهات الجلدية، وأنها تحرم إذا كان الهدف منها التزين وزيادة الجمال، ويجوز في حال الضرورة فقط: كالتداوي به أو إزالة عيب أو تمويهه، ولكن بشروط وضوابط شرعية، ويجوز إزالة آثارها إذا ترتب عليها ضرر؛ لأن الضرر مرفوع في الشريعة الإسلامية. لذلك ترى الباحثة: ضرورة توعية الناس حول التجميل بهذه التقنية وما له من مزايا وأضرار، بما يتوافق مع أحكام الشريعة الإسلامية، وسن القوانين التي تنص على اقتصار التجميل بهذه التقنية على المراكز والعيادات الطبية، وتحت الإشراف الطبي، مع أهمية تعزيز المكتبة الفقهية بالأبحاث الفقهية الطبية لما يستجد من النوازل المعاصرة.
|b The objective of this study is to underscore the Islamic perspective on “camouflage” as a new technique in cosmetic surgery- an emerging issue in reconstructive surgery. It also highlights different jurisprudential rulings regarding conditions and regulations of permissible “camouflage” and concealing surgical scars in case of negative effects. For this purpose, I used extrapolatory and analytical approaches. Accordingly, I collected reliable literary material related to this technique in order to be discussed and included in every single item of the study. I also utilized comparative approach to explore and compare different opinions of scholars from the Four Schools of Islamic Jurisprudence on relevant issues. Among the main findings of the study is that “camouflage” in cosmetic surgery is permissible in Islamic Law when it is performed with intent to conceal or purify skin defects such as dermatological disorders. Therefore, it is allowed in necessary cases to treat, camouflage or conceal skin deformities, under specific jurisprudential regulations and conditions. However, “camouflage” is forbidden when used for aesthetic purposes. On this basis, surgical scars can be avoided and removed in case of harm as stipulate d by Islamic Law. Subsequently, the researcher recommends sensitizing people about the advantages and inconveniences of “camouflage” in cosmetic surgery according to the provisions of Sharia. She also advocates enacting laws to limit cosmetic surgery to specialized skincare centers, under competent medical supervision. Furthermore, she encourages more jurisprudential studies on emerging medical issues seeking to extend the scope of religious research and publications in this field.
