|a الموضوع الذي تدور حوله الدراسة، هو: الاعتراض بدعوى نفي الفائدة، وهو طريق سلكه بعض الأصوليين عند حجاجهم مع المخالفين، وكما هو معلوم فإن الدعوى- في ساحة الحجاج- تبقى مجرد دعوى إلى أن يثبت صحة مستندها. وتهدف الدراسة إلى بيان الجانب النظري والتطبيقي، لتلك الدعوى وفق منهج علمي قائم على الاستقراء والتحليل. وكان من أبرز النتائج: 1- أن المقصود بالاعتراض بدعوى نفي الفائدة: مقابلة الخصم بقول يقصد به إثبات أن قوله يمنع من ترتب المصلحة المقصودة شرعا حقيقة أو حكما. ٢- أن لنفي الفائدة أسبابا، ظهر من خلال البحث أنها تدور بين حشو ولغو ودور، وكان الباعث لدعوى النفي: تنزيه خطاب الشارع عن كل ما لا يليق، ورغم ذلك لم تثبت صحة تلك الدعوى في جميع مسائل البحث.
|b The topic that the study taking about is: Objection of Denying Interest, it is a path taken by some fundamentalists when confronting Opposes. As is known, the lawsuit - in facing Opposes - remains just a lawsuit until the validity of its document is proven. The study aims to explain the theoretical and practical aspects of this lawsuit according to a scientific approach based on induction and analysis. Most noticeable results: 1. The intended meaning of “objection based on the claim of denying benefit” is confronting the opponent with an argument that aims to prove that their statement prevents the realization of the benefit intended by Shariah, either in reality or judgmentally. 2. The reasons for denying benefit, as revealed by the study, revolve around redundancy, triviality, or circularity. The motivation for invoking this claim lies in purifying Allah discourse from anything unbefitting. Nonetheless, the validity of this claim was not proven in all the cases examined in the study.
