|a يهدف هذا البحث إلى بيان ثمرة علم أصول الفقه، وظهور أثر قواعده؛ وذلك بالربط بينها وبين الفروع الفقهية المتعلقة بالآداب الشرعية والأخلاق الإسلامية، وقد انتظم هذا البحث في مقدمة وستة مباحث وخاتمة، أما المباحث الخمسة الأولى فقد خصصت في الدراسة النظرية وهي: التعريف بعلم تخريج الفروع على الأصول، والتعريف بالآداب الشرعية، والتعريف بالإمام ابن مفلح المقدسي، والتعريف بكتاب الآداب الشرعية والمنح المرعية، والتعريف بالأمر والنهي، وأما المبحث السادس والأخير: فقد خصص في التطبيق العملي لعلم تخريج الفروع على الأصول، وذلك بتخريج الفروع الفقهية المتعلقة بالآداب الشرعية المخرجة على القواعد الأصولية في مباحث الأمر والنهي الواردة في كتاب الآداب الشرعية للإمام ابن مفلح رحمه الله، ثم اتبعت ذلك بخاتمة: توصلت فيها إلى أهم النتائج في هذا البحث.
|b This article aims to demonstrate the practical outcomes of the science of principles of jurisprudence and its influence by linking its foundational principles with specific subsidiaries related to Islamic ethics and moral values. The study is divided into six sections and a conclusion. Section 1 deals with defining the concept of “narrating subsidiaries over originals”. Section 2 focusses on exploring the meaning of Sharia ethics. Section 3 introduces Imam Ibn Muflih AlMaqdisi. Section 4 examines the content and significance of his book al-Adab al-Shariyyah. Section 5 analyzes the principles of commanding good and forbidding evil. Section 6 provides a empirical application of referencing subsidiaries over originals by extracting and analyzing jurisprudence subsidiaries related to Sharia ethics based on originals of commanding good and forbidding evil as presented in al-Adab al-Shariyyah. The study concludes with emphasizing the significance of linking foundational principles with empirical jurisprudential applications.
