|a تهدف هذه الدراسة إلى تسليط الضوء على جريمة خيانة الأمانة التي تعد من الجرائم الاقتصادية التي تتعلق بالثقة والأمانة في العلاقات المهنية والاجتماعية، بحيث تحدث هذه الجريمة عندما يتصرف شخص بممتلكات أو أموال مؤتمن عليها بشكل يتعارض مع الأمانة أو الثقة الممنوحة له، ومما لاشك فيه فهذه الجريمة من الجرائم الخطيرة لأنها تؤثر على الثقة في المعاملات التجارية والاجتماعية وتلحق أضرارا كبيرة بالمجتمع والاقتصاد، وستتطرق الدراسة لماهية هذه الجريمة والأركان التي تقوم عليها من النشاط الإجرامي ومدى تحققها، ومدى تحقق الركم المعنوي للقصد الجنائي للجاني، والعقوبات المطبقة على هذه الجريمة وبعض الجرائم الملحقة بها.
|b This study aims to shed light on the crime of breach of trust, which is considered one of the economic crimes related to trust and integrity in professional and social relationships. This crime occurs when a person handles property or funds entrusted to them in a manner that contradicts the trust or confidence granted to them. Undoubtedly, this is a serious crime as it undermines trust in commercial and social transactions, causing significant harm to society and the economy. The study will address the nature of this crime, the elements it is based on, including the criminal activity and its occurrence, the realization of the mental element of criminal intent on the part of the perpetrator, the penalties applied to this crime, and some related offenses.
