|a يتناول البحث موضوع استثمار الولي مال القاصر من خلال المتاجرة به، ولأهميته ووجود اختلاف في طرق الاستثمار، ولأن المال من أهم مقاصد الشريعة الإسلامية، احتاجت هذه المسألة لبيان الضوابط التي يجب على الولي الالتزام بها أثناء استثماره مال القاصر، فقسمت البحث إلى ثلاثة مطالب اشتمل الأول منها على تحليل مصطلحات البحث ببيان معنى الضابط والقاصر والولي والاستثمار، ثم انتقلت إلى بيان الضوابط التي لابد للولي من الالتزام بها وذلك في مطلبين اشتمل الأول منهما على ضوابط استثمار الولي مال القاصر بالمتاجرة به، أما الثاني فقد ذكرت به المسائل المعاصرة المتعلقة به، مقارنة في ذلك بين المذاهب الفقهية الأربعة.
