المستخلص: أهداف البحث: توضيح العناية بضبط مقاصد النكاح وأن الأصل في تشريع أمر العائلة هو إحكام آصرة النكاح، ثم إحكام آصرة القرابة، ثم إحكام آصرة الصهر، ثم إحكام كيفية انحلال ما قبل الانحلال من هذه الأواصر. منهج البحث: تحليلي استقرائي. لا يخفى أن الشارع الحكيم اهتم بالزواج اهتماما خاصا وجعل للأسرة مكانة مميزة، وناط بها مهمة حضارية ودورا استخلافيا، قوامه رعي مصالح الأفراد فيما شرعه من أحكام، ولما كانت الأسرة هي دعامة المجتمع وقوامه، فلا غرو أن تكون العناية بضبط نظامها من أعظم ما يرمي إليه الإسلام، ولا جرم أن الأصل الأصيل في تشريع أمر العائلة هو إحكام آصرة النكاح ثم إحكام آصرة القرابة ثم إحكام آصرة الصهر ثم إحكام كيفية انحلال ما يقبل الانحلال من هذه الأواصر الثلاث. أهم النتائج: 1. أن مقصود الشارع من النكاح أن تكون صورته مخالفة لسائر صور الاقتران المحظور الموجبة لتعريض النسب للشك. ٢. لما كانت الأسرة هي دعامة المجتمع وقوامه، فلا غرو أن تكون العناية بضبط نظامها من أعظم ما يرمي إليه الإسلام. أهم التوصيات: دراسة ما يجد في هذا الزمن من محاولة تشريع طرق لإثبات النكاح الشرعي تخالف بعض ما قررته الشريعة.

The Most Important Results: 1. The intention of the street in the marriage is that its image is contrary to all other forms of prohibited marriage that require exposing the lineage to doubt. 2. Since the family is the pillar and strength of society, it is not surprising that taking care of controlling its system is one of the greatest aims of Islam. The most important recommendations: Study what is found at this time of trying to legislate ways to prove legal marriage contrary to some of what is decided by Sharia.
