|a تتصف الشريعة الإسلامية بأنها صالحة لكل زمان ومكان، قادرة على استيعاب المسائل المعاصرة، بما يكفل للمستفتي أن يجد جوابه فيها بعد الرجوع إلى أهل الفتوى، من خلال اعتمادهم على الأدلة الأصلية والتبعية، ومن هؤلاء ابن عابدين الذي اهتم بوضع القواعد التي يتبعها المفتي عند تعدد الأقوال الاجتهادية، وبين حكم المسائل المستجدة في عصره، وهذا ما حوته حاشيته المعروفة "رد المحتار على الدر المختار" وقد خرج هذا البحث بدراسة مستقلة لأهم المستجدات المتعلقة بالمسائل وحوادث الفتوى عند ابن عابدين من خلال حاشيته المذكورة، بما أجاب عنه في مسائل الزواج والطلاق ومن ثم دراستها دراسة فقهية مقارنة بالقانون السوري، لتوضيح الرؤية المنهجية عند ابن عابدين في تعامله مع هذه الوقائع، والأدلة التي استدل بها في كل مسألة.
