|a يؤدي نظام التحفيظ العقاري دورا مهما في إرساء دعائم قانونية صلبة للملكية العقارية، كما يساهم في تجاوز كل المشاكل التي يعرفها العقار غير المحفظ، لذلك نجد العديد من الفقهاء ينادون بفرض إلزامية هذا النظام وبالتالي تعميمه، إلا أن عوامل عدة تحول دون الوصول إلى هذا المبتغى مما يؤدي ذلك إلى تعميق أزمة الازدواجية. ويعتبر التراخي في إتمام مسطرة التحفيظ العقاري من الأسباب التي تساهم في تكريس هذا الوضع السلبي خاصة عندما يتم إلغاء أو رفض مطالب التحفيظ أو التعرضات. وقد ارتئينا في هذه الدراسة المتواضعة تسليط الضوء على مصطلح التراخي، بيان أسبابه، ثم بيان انعكاساته السلبية واقتراح حلول وبدائل لتخطيها.
|b The real estate preservation system plays a crucial role in establishing a solid legal framework for property ownership, as well as in overcoming all the issues associated with unregistered properties. Therefore, many jurists advocate for the mandatory implementation and universalization of this system. However, several factors hinder the achievement of this goal, leading to the deepening of the crisis of duplication. One of the reasons contributing to this negative situation is the leniency in completing the procedures of real estate preservation, especially when preservation requests or objections are canceled or rejected. In this humble study, we aim to shed light on the concept of leniency, explain its causes, discuss its negative consequences, and propose solutions and alternatives to overcome it.
