|a يتناول هذا البحث منهج الإمام الكاساني في الاستدلال الأصولي على الأحكام الفقهية في كتابه بدائع الصنائع، بجمع أمثلة تطبيقية تعين على فهم تلك القواعد والأسس المذكورة في علم الأصول، واخترت كتاب بدائع الصنائع ليكون مصدرا لتلك الأمثلة، قام البحث على المنهج الوصفي وأدواته من استقراء وتحليل، استقرأت أمثلة عديدة من كتاب بدائع الصنائع واخترت أظهر الأمثلة وأبينها. واعتمدت الطبعة التي صورتها دار الكتب العلمية من الطبعة القديمة الحجرية، وانقسم البحث إلى ثلاثة مباحث الأول عن الاستدلال وأنواعه، والثاني منهج الإمام الكاساني في الاستدلال الأصولي، والأخير استدلال الإمام الكاساني بدلالة النص أو اقتضاء النص.
|b This research deals with the approach of Imam Al-Kasani in the fundamentalist inference of jurisprudential rulings in his book Bada'i Al-Sanayeh, by collecting practical examples that help to understand those rules and foundations mentioned in the science of assets, and I chose the book Bada'i Al-Sanayeh to be the source of those examples, The research was based on the descriptive approach and its tools of extrapolation and analysis, I extrapolated many examples from the book Bada'i al-Sanayeh and chose to show and show the examples. The edition photographed by Dar al-Kutub al-Ilmiyya was adopted from the old lithograph, The research was divided into three sections, the first on inference and its types, the second approach of Imam Kasani in fundamentalist reasoning, and the last inference of Imam Kasani in terms of the text or the requirement of the text.
