|a تعتبر الكمبيالة أهم ورقة تجارية في القانون التونسي وهي تتكون من ثلاثة أطراف، أي بمعنى آخر، تتضمن الكمبيالة على أمر صادر من طرف أول يدعى الساحب إلى طرف ثان يدعى المسحوب عليه الذي عليه أن يقوم بخلاص أجر لطرف ثالث يدعى الحامل أو المستفيد في تاريخ معين؛ وفي العموم، فإن الهدف من هذا البحث هو تسليط الضوء على مقتضيات إنشاء الكمبيالة في القانون، أي بمعنى أدق، إلى المقتضيات الأصلية والشكلية لنشأة الكمبيالة وذلك في القانون التونسي.
|b The bill of exchange is considered the most important commercial paper in the Tunisian law, and it consists of three parties. Or in other words, the bill of exchange includes an order issued by a first party called the drawer to a second party called the drawee, who must pay a fee to a third party called the bearer or beneficiary on a specific date. In general, the aim of this research is to shed light on the requirements for creating a bill of exchange in the law, that is, more precisely, the original and formal requirements for creating a bill of exchange in the Tunisian law.
