|a أدى انتشار الثورة الرقمية إلى تحولات في عالم التجارة، حيث باتت التجارة الإلكترونية أحد أهم سمات العصر، وتعتبر المواقع الإلكترونية أهم ركائز هذه التجارة، وقد كانت للعقود التي سمحت بإنشائها جانب كبير من الأهمية، أحد أهم هذه العقود هو عقد الإيواء الإلكتروني، حيث تقوم الجهة مقدمة خدمة الإيواء بتقديم مساحة على خوادمها وبعض إمكانيات أجهزتها لتتيح للعميل تخزين بيانات موقعه الإلكتروني وعرضها فيما بعد، ولكن هذا العقد، بما يحتويه من أهمية، لم يواكبه التطور القانوني الذي يشمل جوانبه ويبين معالمه، فكان هذا البحث للتعريف بهذا العقد وتحديد طبيعته القانونية وآثارها على أطرافه.
