|a تهدف هذه الدراسة إلى التعرف على واقع صيغ التمويل الإسلامي في الجزائر في ظل الامتثال للرقابة الشرعية وضرورة تطبيق النصوص التنظيمية الصادرة عن بنك الجزائر. وتتلخص أهم النتائج في أن صيغ التمويل الإسلامي في الجزائر تخضع إلى رقابة المصرف المركزي في إطار القانون النقدي والمصرفي 23-09 والنصوص التنظيمية الصادرة عنه والذي لا يراعى خصوصية عملها، وعلى رأس تلك الخصوصيات الامتثال للرقابة الشرعية التي لم تحظ بذلك الإطار القانوني اللازم الذي يجعلها متكاملة الجوانب لتحقيق أهداف المصرف الإسلامي وعلى رأسها كسب ثقة العملاء.
|b This study aims to identify the reality of Islamic financing instruments in Algeria in ful compliance with the shariah supervisory, and the need to implement the regulatory texts issued by the Bank of Algeria. The main results are summed that the Islamic financing instruments in Algeria are subject to censorship of the central bank, within the frame work of the monetary and banking law 23-09 and the regulatory texts issued by therefrom, which do not take into account the specificity of their work, and the most important of these specificities is compliance with Sharia supervision, which did not have the necessary legal framework that makes it integrated in achieving the objectives of the Islamic bank, most importantly gaining customer’s trust.
