المستخلص: With the interest of the family in general, and that of the woman and child in particular, at the heart of his royal concerns, His Majesty King Mohammed VI, may God assist him, announced in 2004 the promulgation the most important reform of his reign, the reform of the Moudawana. This reform was considered the beginning of a socio-legal revolution given its role in improving the conditions of the family unit by ensuring the protection of the women and children rights. However, its implementation was hindered by sociological, legal, and cultural obstacles. 20 years later, this revolution seems obsolete, presents shortcomings and a certain inadequacy with the needs of a rapidly changing society and therefore a new reform is born. Like its predecessor, this reform was initiated by His Majesty in 2022 on the occasion of the Throne Speech and was materialized by the letter of His Majesty to the head of government for the opening of this project. Before the realization of this project, it seems necessary to take stock of the balance of the current Code, the possible contributions of the current reform as well as the lessons to be learned from the obstacles that the 2004 Moudawana has known.

Ayant l'intérêt de la famille en générale, et celui de la femme et de l'enfant en particulier, au coeur de ses préoccupations royales, Sa Majesté le Roi Mohammed VI, que Dieu l'assiste, a annoncé la promulgation en 2004 la plus importante réforme de son règne, celle de la moudawana. Cette réforme a été considérée comme le début d'une révolution sociojuridique vu son rôle dans l'amélioration des conditions de la cellule familiale en veillant à la protection des droits de la femme et de l'enfant. Néanmoins, sa mise en application a été entravée par des obstacles sociologiques, juridiques et culturels. 20 ans plus tard, cette révolution semble obsolète, présente des insuffisances et une certaine inadéquation avec les besoins d'une société en pleine mutation et donc une nouvelle réforme voit le jour. Comme sa précédente, cette réforme a été initiée par Sa majesté en 2022 à l'occasion du discours de Trône et a été concrétisée par la lettre de sa Majesté au chef du gouvernement ayant pour objet l'ouverture de ce chantier. Avant la concrétisation de ce projet, il semble nécessaire de faire le point sur le bilan du Code en vigueur, les apports possibles de la réforme en cours ainsi que les leçons à tirer des entraves qu'a connu la moudawana de 2004.
