المستخلص: في هذا البحث المعنون بـ: "صيانة الشريعة الإسلامية للأسرة من الطلاق دراسة تأصيلية" محاولة لبيان الكيفية التي يمكن أن تساهم بها المقاصد الشرعية في حفظ الأسرة من عوامل الفرقة كالطلاق ونحوه من خلال الحديث عن أهمية المقاصد الشرعية في حفظ الأسرة، وذكر المقاصد الشرعية في مشروعية الطلاق، وبيان أبرز الأسباب التي أدت إلى تنامي حالات الطلاق في مجتمعنا، وأثر المقاصد الشرعية في الحد من هذه المشكلة. وقد اتبعت في هذا البحث المنهج الاستقرائي التحليلي للنصوص الواردة في فقه الأسرة، وما اشتملت عليه من مقاصد شرعية. وكذلك البحث عن الأسباب المؤدية للطلاق من خلال الدراسات التي اعتنت برصد هذه الظاهرة. ومن أبرز نتائج البحث: بيان دور المقاصد الشرعية في الحفاظ على كيان الأسرة المسلمة، وحمايته من التفكك والضياع، وأن المقصد الشرعي من مشروعية الطلاق جاء مراعياً لمصلحة كل من الزوجين، ومبنياً على المحافظة على بقاء العلاقة الزوجية، واستمرارها قدر الإمكان. وأهمية الدورات التأهيلية للمقبلين على الزواج في التقليل من حالات الانفصال.

In this research entitled: “Islamic Sharia's protection of the family from divorce, a fundamental study”, there is an attempt to show how Sharia intentions can contribute to protecting the family from the factors of dissection such as divorce and the like, by discussing the importance of Sharia intentions in safeguarding the family, stating the Sharia intentions in legalizing divorce, and explaining the most prominent reasons that led to the increase of divorce cases in our society, as well as the influence of Sharia intentions in diminishing this problem. In this research, I followed the inductive-analytical approach to the texts concerning the family jurisprudence and the Sharia intentions it included, as well as searching for the causes leading to divorce through studies devoted to monitoring this phenomenon. Among the most important research results: explaining the role of Sharia intentions in protecting the entity of the Muslim family and protecting it from disintegration and loss, and that the Sharia intent of the legality of divorce was derived from taking into account the interests of both spouses and based on protecting the constancy of the marital relationship and its continuity as much as possible. In addition, the research stresses the importance of rehabilitation courses for those who are about to marry in reducing cases of divorce.
