|a إن قضية التوقيف والاصطلاح في وضع اللغة العربية تناولتها العلوم المختلفة، فتكلم فيها اللغويون والبيانيون والأصوليون، وانقسم الناس فيها فرقا، وتكمن أهمية هذا البحث في استقراء كلام الفقهاء في مسائل الفروع ثم بيان تأثر الفتاوى فيها بهذه القضية؛ وذلك لأن الفقيه يذكر الفرع الفقهي من غير تعرض لبيان الأصل الذي تفرع عنه، وفي ذلك جواب عن إشكالية يطرحها كثير من الطلبة حول هذه القضية وهي هل لقضية التوقيف والاصطلاح تأثير في فروع الفقه أم لا؟ فإن كان كذلك فما هي مستويات هذا التأثير وأشكاله؟ ولهذا كله سأقوم أولا ببيان الخلاف في هذه القضية مع ذكر حجة كل فريق، ثم أبين القول الراجح منها، وبعد ذلك أنتقل للهدف الأساس من هذا البحث وهو تعداد مسائل الفروع التي تتأثر بهذه القضية، فأقوم بشرح هذه الفروع أولا، ثم بيان الراجح فيها وكيفية تفريعها على قضيتنا. وقد اعتمدت في تناول هذه المسائل ومناقشتها علميا وموضوعيا المنهج التحليلي من خلال تتبع كلام الفقهاء واستقراء الفتاوى في الأبواب المختلفة، ثم تحليل ذلك بعرضه على الخلاف في قضية وضع اللغة، مبينا الراجح في كل فرع منها.
|b The issue of whether the Arabic language is divinely determined (tawqif) or a product of human convention (istilah) has been a topic of discussion across various disciplines. Linguists, rhetoricians, and scholars of Islamic jurisprudence (usul) have debated it extensively, leading to differing perspectives. The significance of this research lies in examining how this debate influences jurisprudential rulings (furu’) and how legal verdicts are affected by this issue. This is particularly important as jurists often present rulings without explicitly referring to the foundational principles underlying them. This study addresses a key question posed by many students: Does the debate around tawqif and istilah impact jurisprudential rulings? If so, what are the levels and forms of this influence? To address this, the research first outlines the differing opinions on the issue, presenting the arguments of each group and identifying the most substantiated view. The main objective is then to enumerate the jurisprudential rulings influenced by this issue. Each ruling is explained, and its preferred opinion is clarified, demonstrating its connection to the broader linguistic debate. The study employs an analytical methodology, systematically reviewing the opinions of jurists and surveying verdicts across various legal domains. These findings are then analyzed in light of the tawqif-istilah debate, with the strongest opinions highlighted in each case.
