المستخلص: سنّ المشرع الجزائري ترسانة من القوانين منذ الاستقلال، بهدف حماية الأراضي الفلاحية والمحافظة عليها، وذلك من خلال حظر تحويل وجهتها الفلاحية، أو استغلالها لأغراض البناء والتعمير مهما كانت المبررات، أو إجراء أي تصرفات عليها مخالفة للقانون، أو تعمد إهمالها وعدم استغلالها، وهذا نظرا لأهميتها في تحقيق الأمن الغذائي وندرتها. غير أن الواقع أثبت خلاف ذلك، حيث تم بالفعل انتهاك الأراضي الفلاحية خاصة أراضي القطاع العام من طرف السلطات العمومية أنفسهم لأغراض البناء، خاصة بعد تكريس حق الدولة في استرجاع أراضيها الممنوحة في إطار المستثمرات الفلاحية، أو اقتطاع جزء منها لأغراض البناء، وأما أراضي القطاع الخاص فقد ثبت التعدي عليها بتقسيمها وتجزئتها، وبيعها قطع أراضي ضئيلة لتشييد أبنية عليها غير مرخصة، ما يعني أن ادعاء حماية الأراضي الفلاحية في الجزائر ووقف استنزافها مجرد وهم وليس حقيقة.

The Algerian legislator has enacted an arsenal of laws since independence, with the aim of protecting and preserving agricultural lands, by prohibiting the conversion of their agricultural lands, or exploitation of them for purposes of construction and reconstruction, whatever the justifications, or carrying out any actions on them in violation of the law, or deliberately neglecting them and not exploiting them, and this is due to their importance in Achieving food security and scarcity. However, reality has proven otherwise, as agricultural lands, especially public sector lands, have actually been violated by the public authorities themselves for construction purposes, especially after enshrining the state’s right to recover its lands granted within the framework of agricultural investments, or to cut off part of them for construction purposes. As for private sector lands, It has been proven that they have been encroached upon by diving and subdividing them, and selling small plots of land to build unlicensed buildings on them, which means that the claim of protecting agricultural lands in Algeria and stopping their depletion is just an illusion and not a reality.
